My wife and I separated shortly after finding out we were pregnant with our first [and only] child. She left our marital home in MS and moved to GA. Our son was born in January. Due to mutual restraining orders and Bond conditions, she prevented me from being present at the birth. In November, before the birth, she changed her name [to her maiden] in GA court without me being notified for consent. When our son was born, she gave him her [maiden] last name, even though we are still legally married. I am on the birth certificate. What is the legality of this action? Can she change her name without giving notice? Can she legally give my child another last other than our married last name? To date, we are still married and going through a nasty divorce. All responses are appreciated in advance.
